Change in Ohio Notary Law
Published: May 28, 2019 by John IzzoOhio recently passed Sub. Senate Bill 263, the Notary Modernization Act. It will take effect on September 20, 2019.
This will allow the Secretary of State to authorize notaries public who are Ohio residents to perform notarizations online using live video links, electronic signatures, and electronic notary seals. This authority is not extended to the taking and certifying of depositions.
In order to be an online notary public, one must complete an educational course and pass an additional test to those necessary to acquire an initial notary commission. This is a five-year term for both attorneys and non-attorneys. Online notaries public will also have to complete a new continuing education requirement.
