Alternate Relief may be Available to Licensees who are Suspended or Revoked
Published: Jun 05, 2020 by John IzzoLittle Butterflies Daycare and Preschool had its daycare license revoked by the Ohio Department of Job and Family services. It appealed the revocation to the Franklin County Court of Common Pleas, and asked the Court to stay the revocation of their license. The stay request was denied by the Common Pleas Court.
Little Butterflies appealed the denial to the Court of Appeals, hoping the Appellate Court would overturn the Common Pleas Court decision to deny the stay. Little Butterflies then asked the Appellate Court to grant a stay of the revocation.
The Court of Appeals denied that request to stay the revocation. However, it suggested Little Butterflies could get the relief it sought by seeking an injunction. The decision can be found here.
