Court: Construction Building Permit Led to Breach of Contract
Published: Apr 03, 2017 by Luther LiggettA construction contractor agreed to install a chimney for a radiant wood-burning stove as part of a residential renovation. When construction began, the contractor refused to install the chimney near a combustible wall, as creating a fire hazard.
Owner sued for breach of contract, having obtained a building permit based on architectural drawings which approved the installation.
The trial court held, and the court of appeals approved, that the contractor breached the contract by objecting to a purported hazard which the building department approved.
