UPDATE – Medical Marijuana Cultivator Rules Clear JCARR

Published: Apr 11, 2017 by John Izzo

UPDATE! JCARR cleared the rules for cultivators and other general provisions regarding the medical marijuana control program. The application process will begin in June 2017. The Department of Commerce will begin reviewing applications in July 2017.

The Department of Commerce will have two sets of rules before the Joint Committee on Agency Rule Review on Monday afternoon, April 17. The General Provisions of the Medical Marijuana Control Program (such as the fee structure for cultivators, processors, testing laboratories, and any employee involved in the process) as well as the Cultivator rules themselves are up for consideration. Although there may be testimony against some of the rules, it is expected that all rules will all go forward in their current state.

In the next week or so, the Department of Commerce will release applications for a cultivator license. All applications will be due by a yet unannounced date.

The rest of the rules for the Medical Marijuana Control Program are slowly working their way through the system. The processor and dispensary rules are with the Common Sense Initiative. The rules for testing laboratories, physicians, and the form and method of medical marijuana are being reviewed, with revisions to be made based upon public comment. These rules should be filed with the Common Sense Initiative soon as well.

If you have any questions about the Medical Marijuana Control Program, including the application and licensing process or how to comment on the proposed rules, you should consider contacting an attorney at Graff & McGovern. John Izzo of Graff & McGovern can be reached at 614-228-5800, extension 5.
