Ohio Medical Marijuana Cultivator Applicants Should Exhaust Administrative Remedies
Published: Jan 05, 2018 by John IzzoPharmaCann Ohio LLC filed a complaint in Franklin County Court of Common Pleas, challenging the constitutionality of Ohio’s medical marijuana law. The State of Ohio filed a motion, asking the Court to dismiss the lawsuit.
The State raised several issues in their Motion, including the fact that PharmaCann did not exhaust its administrative remedies and did not develop an administrative hearing record for the court to review.
According to the Hannah Report published on January 4, 2018, Judge Charles Schneider said, “This case isn’t going to go away that easily.”
